Website Terms of Use — Watchwork AI

1. About these terms

These Website Terms of Use (Terms) apply when you visit or use https://watchwork.au (the Site), including when you submit an enquiry form.

The Site is operated by Watchwork AI (public brand often Watchwork), an individual sole trader of Queensland, Australia.

By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Paid client engagements are governed by our Client Services Agreement (and any scope document and Acceptable Use schedule), not solely by these Website Terms. If there is a conflict for a paid engagement, the Client Services Agreement prevails for that engagement.

2. What the Site is for

The Site provides information about Watchwork’s services: setup and configuration of AI and automation into a client’s own business systems (including PA-style workflows and telephony on the client’s number), and ongoing care under a monthly retainer. Content is general information only. It is not legal, financial, medical, or other professional advice, and it is not a binding offer until we confirm an engagement in writing.

Watchwork’s usual clients are businesses. Site content is aimed at business operators evaluating B2B services.

3. Enquiry form and contact

If you submit an enquiry or email us:

  • you confirm the information you provide is accurate to the best of your knowledge;
  • you consent to us using your details to respond and, where relevant, to discuss a possible engagement;
  • our Privacy Policy explains how we handle personal information.

Do not submit unlawful, offensive, or confidential third-party information you are not entitled to share. You are responsible for the content of your enquiry.

4. Acceptable use of the Site

You must not:

  • misuse the Site (including attempting to hack, scrape aggressively, overload, or disrupt it);
  • use the Site to send spam or unlawful content;
  • misrepresent your identity or affiliation;
  • copy substantial Site content for commercial reuse without our prior written consent;
  • introduce malware or attempt unauthorised access to our systems or other users.

We may suspend or block access if we reasonably believe you have breached these Terms.

Client use of configured AI, messaging, and telephony systems after engagement is governed by the Client Services Agreement and the Acceptable Use Policy, not only by this clause.

5. Intellectual property

Site text, branding, layout, and materials are owned by Watchwork or its licensors. You may view and print pages for personal or internal business evaluation. You may not republish or commercially exploit Site content without permission, except for fair dealing or other rights under Australian copyright law.

“Watchwork” / “Watchwork AI” branding as used on the Site identifies our business. Watchwork methods and playbooks described in general terms on the Site remain Watchwork IP.

6. Third-party links and tools

The Site may link to third-party websites or mention tools and providers (including AI, telephony, or productivity tools). We do not control those sites or providers and are not responsible for their content, availability, terms, charges, or privacy practices. Links and mentions are not endorsements and are not part of a Watchwork-hosted platform.

7. Disclaimer and Australian Consumer Law

To the extent permitted by law, the Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that Site content is complete or current for your circumstances.

Non-excludable rights: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (ACL) or other law that cannot lawfully be excluded. Where these Terms limit or exclude liability, they do so only to the extent permitted by law.

Where liability can be limited for goods or services not ordinarily acquired for personal, domestic, or household use, our liability is limited to resupply or the cost of resupply, at our option.

8. Limitation of liability

Subject to clause 7 and to the extent permitted by law:

  • Watchwork is not liable for consequential, indirect, incidental, special, or pure economic loss (including lost profits, revenue, goodwill, or data) arising from your use of, or inability to use, the Site;
  • for mere browsing or use of the Site without a separate paid engagement with Watchwork, Watchwork’s aggregate liability arising from Site use is limited to nil;
  • if you paid Watchwork a fee for a Site-related paid service (other than under a Client Services Agreement, which has its own cap), aggregate liability for that Site-related service is limited to the fees paid for that service in the 12 months immediately before the claim arises.

Paid engagements are governed by the liability, indemnity, and third-party clauses in the Client Services Agreement.

This clause allocates commercial risk; it does not claim immunity from all claims or from non-excludable ACL rights.

9. Privacy

Personal information collected via the Site is handled under our Privacy Policy.

10. Changes

We may update these Terms by posting a revised version on the Site with an updated date. Continued use after changes means you accept the updated Terms for subsequent visits. Material changes affecting active contractual clients will be handled under the Client Services Agreement where relevant.

11. Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
